1. Who we are
Canvas & Click ("we", "our", "us") operates the website at canvas-click.myshopify.com. These Terms of Service ("Terms") govern your access to and use of our website and your purchase of our products. By using the site or placing an order, you agree to these Terms.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the site you represent that you meet that requirement.
3. Products and designs
All products are made to order. Designs are original artwork created by Canvas & Click. Some designs incorporate AI-assisted composition or generative tools as part of our creative process; final artwork is curated, edited, and approved by us. Product colors on your screen may vary slightly from the finished piece due to differences in display calibration, printing, and the handcrafted nature of made-to-order goods.
4. Orders, pricing, and acceptance
Placing an order constitutes an offer to buy. We reserve the right to accept or decline any order, including for stock, pricing, fulfillment, or fraud-screening reasons. Prices are listed in US dollars and are subject to change without notice; the price at checkout is the price you pay. We reserve the right to correct pricing or product errors and to cancel affected orders with a full refund.
5. Payment
Payments are processed securely through Shopify Payments and Shop Pay. We do not store full credit card information on our servers. By placing an order you authorize us to charge your selected payment method for the total order amount.
6. Shipping
Production takes 2–5 business days. Transit times vary by destination — see our Shipping Policy for details. Risk of loss passes to you upon delivery to the shipping carrier. Customs, duties, and import taxes for international orders are the responsibility of the recipient.
7. Returns and refunds
Because every item is made to order, we do not accept general returns. We replace or refund items that arrive damaged, defective, or materially different from what was advertised — see our Refund Policy for the full process and timelines.
8. EU and UK consumer rights
If you are a consumer ordering from the European Union or the United Kingdom, you generally have a 14-day right of withdrawal from a distance-sale purchase. That right does not apply to goods that are made to your specifications or clearly personalized. All Canvas & Click products are produced individually for each order, so this exemption applies. Statutory rights for items that arrive faulty, damaged, or not as described are unaffected and are addressed in our Refund Policy.
9. Chargebacks
If you have a problem with your order, please contact us first — most issues can be resolved within one business day. Initiating a chargeback before contacting us may delay or prevent a resolution. Chargebacks deemed fraudulent or filed in bad faith may be disputed and reported to the relevant payment networks.
10. Intellectual property
All designs, images, and text on this site are the property of Canvas & Click and protected by copyright and other applicable laws. You may not reproduce, resell, redistribute, or create derivative works from our designs without our prior written permission. Limited personal use of purchased products is permitted; commercial resale of products purchased from us is not.
11. Copyright complaints
If you believe content on our site infringes a copyright you own, send a written notice to david.a.moline@gmail.com with: (a) identification of the copyrighted work, (b) the URL of the allegedly infringing material, (c) your contact information, (d) a statement of good-faith belief that the use is not authorized, (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act on the rights holder's behalf, and (f) your physical or electronic signature.
12. Acceptable use
You agree not to use the website to violate any law, infringe on anyone's rights, transmit malware, scrape content for commercial use without permission, or attempt to gain unauthorized access to our systems or other users' accounts.
13. Electronic communications
By placing an order or creating an account, you consent to receive electronic communications from us related to your purchase, including order confirmations, shipping updates, and customer-service correspondence. Marketing emails require separate opt-in and can be unsubscribed at any time using the link in any marketing email.
14. Disclaimers and warranties
The website and products are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in our Refund Policy.
15. Limitation of liability
To the maximum extent permitted by law, Canvas & Click is not liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or products. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow limitations on certain warranties or damages, so portions of this section may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless Canvas & Click and its operators from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of our site or products, or your violation of any law or third-party right.
17. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Sheridan County, Wyoming, and you and we each consent to personal jurisdiction there. To the extent permitted by law, both parties waive any right to a jury trial and to participate in a class action regarding any dispute under these Terms. Nothing in this section limits the rights of consumers under mandatory local law in their place of residence.
18. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Material changes will be communicated by a notice on this page. Continued use of the site after a change means you accept the updated Terms.
19. Severability and entire agreement
If any portion of these Terms is found unenforceable, the remaining portions stay in effect. These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and us regarding your use of the site.
